{"id":12842,"date":"2021-12-16T12:48:35","date_gmt":"2021-12-16T12:48:35","guid":{"rendered":"https:\/\/voice.org.rs\/?p=12842"},"modified":"2021-12-16T12:48:35","modified_gmt":"2021-12-16T12:48:35","slug":"from-a-whistleblower-to-winner-at-public-procurements","status":"publish","type":"post","link":"https:\/\/voice.org.rs\/en\/from-a-whistleblower-to-winner-at-public-procurements\/","title":{"rendered":"From a \u201cWhistleblower\u201d to Winner at Public Procurements"},"content":{"rendered":"\r\n\r\n<strong>Former legal representative of the \u201cRespect Legal\u201d company, Dan\u010de Uro\u0161evi\u0107, who in November 2019 accused Marko Basta\u0107, then-president of the municipality of Stari grad, of corruption did not lose his job, nor was his company shut down, as he announced at the time, but he went on to win public procurements in partnerships with various companies, an investigation conducted by the Vojvodina Investigative and Analytical Center (VOICE) shows.<\/strong>\r\n\r\n\r\n\r\nEven though both the legal representative and registered address have been changed, <strong>Respect Legal<\/strong>\u00a0continued to win public procurements in Serbia. On the other hand, Dan\u010de Uro\u0161evi\u0107 continued to cooperate with his former company through the <strong>Transly <\/strong>company and secure <strong>deals worth more than a million euros <\/strong>following public procurements organized by local self-governments, public companies and institutions in Serbia\r\n\r\n\r\n\r\nAs our investigation shows, despite controversial tenders that have prompted a reaction from the Anti-corruption Department of the Ministry of Interior of Serbia, the \u201cRespect Legal\u201d company has been awarded contracts whose total worth is around <strong>EUR<\/strong> <strong>1.3 million <\/strong>over the past four years.\r\n\r\n\r\n<h2 class=\"wp-block-heading\" id=\"h-company-s-history\"><strong>Company\u2019s history<\/strong><\/h2>\r\n\r\n\r\nThe \u201cRespect Legal\u201d company was <strong>founded <\/strong>in mid-September, 2016, with the initial capital of one thousand dinars. <strong>Stefan Uro\u0161evi\u0107<\/strong> was registered as the legal representative with the Serbian Business Registers Agency (BRA). Four months after the company was established, \u201cRespect Legal\u201d, LLC moved from Novi Beograd to Rakovica, i.e. <strong>apartment no. 1<\/strong> on the ground floor of a residential building located in 35 Luke Vojvodi\u0107a Street.\r\n\r\n\r\n\r\nThe \u201cRespect Legal\u201d company has a branch office in Ni\u0161, registered, just like the central office in Belgrade, at: <strong>apartment 7<\/strong>,15 Bubanjskih Heroja Street<strong>.<\/strong>\r\n\r\n\r\n\r\nThe company takes part in public procurements in consortia with <strong>other companies<\/strong>:\u00a0\u201cSistem \u2013 FPS obezbe\u0111enje\u201d, \u201cASP Serbia\u201d, \u201cAVB Team\u201d, \u201cCodex Trade\u201d, \u201cG2 Falcon 2017\u201d and \u201cTransly\u201d.\r\n\r\n\r\n\r\nAs the investigation conducted by VOICE shows, \u201cRespect Legal\u201d was awarded <strong>the first contract <\/strong>just three months after it was founded, as the main contractor, while the other company that participated in the joint bid was \u201cSistem \u2013 FPS obezbezbe\u0111enje\u201d, whose founder and legal <strong>representative was<\/strong>\u00a0<strong>Dan\u010de Uro\u0161evi\u0107<\/strong>. Following a call for bid issued by the General Hospital in Leskovac, this company was awarded a contract <strong>worth <\/strong>around RSD 1.6 million on November 29, 2016.\r\n\r\n\r\n<div class=\"wp-block-image\">\r\n<figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"501\" class=\"wp-image-7311\" src=\"http:\/\/voice.flywheelstaging.com\/wp-content\/uploads\/2020\/12\/Beograd_night-foto-Wikimedia.png\" alt=\"\" srcset=\"https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/Beograd_night-foto-Wikimedia.png 700w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/Beograd_night-foto-Wikimedia-300x215.png 300w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/Beograd_night-foto-Wikimedia-400x286.png 400w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><figcaption>From Belgrade&#8230; (foto: Wikimedia)<\/figcaption><\/figure>\r\n<\/div>\r\n\r\n\r\nThe following year, 2017, saw \u201cRespect Legal\u201d awarded <strong>eight contracts <\/strong>worth around RSD 45,390,000 as part of bidding consortia at public procurements organized by local self-governments, public companies and institutions.\r\n\r\n\r\n\r\nThe company was put under the <strong>public spotlight <\/strong>on October 25, 2017, due to a contract worth five million dinars with the \u201cVidrak\u201d public company from Valjevo.\r\n\r\n\r\n\r\nThe contract with \u201cRespect Legal\u201d was signed on February 28, 2017, while a decision on amending the contract, which saw the value of the public procurement raised by RSD 250,000, was made after six months, as it was reported by the <strong>Kolubarske.rs <\/strong>portal. According to this portal, the public procurement for \u201cprovision of staff security services, including fixed-term employment contracts\u201d saw 51 people finding employment for a period of one year, including managers and supervisors.\r\n\r\n\r\n\r\nThe list of the employed staff includes an internal auditor, a legal officer, a public procurement officer, a business secretary, a planning officer, garbage truck drivers, cashiers, a parking control officer, a landscaping expert and a dog sitter. The portal reported that among those awarded employment contract for a fixed period of one year were the head of technical department and recycling and workshop supervisors.\r\n\r\n\r\n\r\nThe investigation conducted by VOICE shows that the controversial public procurement had no impact on future operations of the company, its participation in public procurements and the fact that it won tenders all over Serbia.\r\n\r\n\r\n\r\nIn 2018, \u201cRespect Legal\u201d changed its core activity, so the Serbian Business Registers Agency replaced \u201cconsulting services related to business and other types of management\u201d with <strong>\u201cactivities related to employment agencies\u201d<\/strong>. Furthermore, the head office moved from the ground-floor apartment in 35 Luke Vojvodi\u0107a, to a first-floor <strong>apartment <\/strong>down the same street (1 Luke Vojvodi\u0107a). At the end of July (25.7. 2018), BRA registered <strong>Dan\u010de Uro\u0161evi\u0107<\/strong>\u00a0as the legal representative. That year, 2018, the company was awarded seven contracts following public procurements for services worth around RSD 48.8 million.\r\n\r\n\r\n<h2 class=\"wp-block-heading\" id=\"h-register-me-deregister-me\"><strong>Register me \u2013 deregister me<\/strong><\/h2>\r\n\r\n\r\nAt the beginning of 2019, \u201cRespect Legal\u201d made the news once again. This time, the occasion was an action conducted by the members of the Anti-corruption department of the Ministry of Interior. Namely, this police department, in cooperation with the Higher Public Prosecutor\u2019s office in Ni\u0161 and the Security Intelligence Agency, arrested three people in February on the charges of committing several criminal acts related to corruption.\r\n\r\n\r\n<div class=\"wp-block-image\">\r\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-7312\" src=\"http:\/\/voice.flywheelstaging.com\/wp-content\/uploads\/2020\/12\/NI\u0160.jpg\" alt=\"\" width=\"515\" height=\"687\" srcset=\"https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NI\u0160.jpg 695w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NI\u0160-225x300.jpg 225w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NI\u0160-300x401.jpg 300w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NI\u0160-637x850.jpg 637w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NI\u0160-400x534.jpg 400w\" sizes=\"auto, (max-width: 515px) 100vw, 515px\" \/><figcaption>&#8230;via Ni\u0161&#8230;<\/figcaption><\/figure>\r\n<\/div>\r\n\r\n\r\nAs the Ministry of Interior stated in their official announcement, among the arrested were a responsible person from the <strong>General Hospital in Leskovac<\/strong>\u00a0N. D. (1965) who allegedly committed a criminal act of influence peddling, a responsible person from\u00a0<strong>\u201cTransly\u201c<\/strong>\u00a0D. S. (1975) under suspicion of committing a criminal act of instigating influence peddling, as well as an employee at the General Hospital in Leskovac M. M. (1963) under suspicion of committing a criminal act of abusing power.\r\n\r\n\r\n\r\nThe Ministry stated that D.S. had instigated N.D to alter the documents related to the public procurement for the provision of services related to hygiene maintenance at the General Hospital in Leskovac, so that \u201c<strong>Transly<\/strong>\u201c and \u201c<strong>Respect Legal<\/strong>\u201c from Belgrade would be able to meet the terms and conditions stipulated in the public procurement documents and, consequently, be awarded the job. Using his official position, N.D. acted as a mediator and persuaded M.M, a member of the committee in charge of public procurements at this hospital, to alter the tender documentation without a prior written request by a bidder, so that \u201cTransly\u201c and \u201cRespect Legal\u201c would gain illegal advantage over other bidders for provision of services related to hygiene maintenance.\r\n\r\n\r\n\r\nIt was also said in the Ministry\u2019s announcement that EUR 22,200, CHF 3,500 and USD 400 were found and confiscated during the house search of the suspect N.D.\r\n\r\n\r\n\r\nWhen examining further operations of \u201cRespect Legal\u201d, VOICE discovered that, despite the fact that a representative of the company he was running had been arrested, Dan\u010de Uro\u0161evi\u0107 remained the company\u2019s legal representative until the middle of that year, when he was replaced by <strong>Vladan Ko\u010dovi\u0107.<\/strong>\r\n\r\n\r\n\r\nThe first rotation occurred on May 23, when Dan\u010de Uro\u0161evi\u0107 was removed from the BRA\u2019s records to be replaced by Vladan Ko\u010dovi\u0107 as the director. Six days later, this decision was nullified and\u00a0<strong>Dan\u010de Uro\u0161evi\u0107 was again registered as the director in the Business Register\u2019s Agency\u2019s records<\/strong>. However, in early June (June 6, 2019) there was another rotation, when Vladan Ko\u010dovi\u0107 was once again registered as the director.\r\n\r\n\r\n\r\nTowards the end of 2019, i.e., on November 11, Dan\u010de Uro\u0161evi\u0107 was characterized as a <strong>whistleblower <\/strong>by the regime-controlled media outlets, since he had accused the then-president of the Belgrade municipality of Stari grad, Marko Basta\u0107, of allegedly embezzling RSD 86 million from the municipality\u2019s budget.\r\n\r\n\r\n\r\n\u201cHaving won the tender, \u201cRespect Legal\u201d was awarded a contract worth RSD 86 million for 2018 and 2019 with the municipality of Stari grad. I accepted the conditions put forward by the municipality\u2019s leaders, which was to employ 60 workers they would select. I found out later that 23 had already been employed elsewhere, but we had to pay their salaries nevertheless, because of blackmails and threats that they would close down my company\u201d, Dan\u010de Uro\u0161evi\u0107 said at the time, adding that he might get into major troubles and \u201cclose down the company\u201d.\r\n\r\n\r\n<h2 class=\"wp-block-heading\" id=\"h-tenders-instead-of-padlock\"><strong>Tenders instead of padlock<\/strong><\/h2>\r\n\r\n\r\nIn his \u201cconfession\u201d, Uro\u0161evi\u0107 stated that he had lost his job because of all that. However, the VOICE\u2019s investigation proves that Dan\u010de Uro\u0161evi\u0107 continued a successful business cooperation with \u201cRespect Legal\u201d unhindered.\r\n\r\n\r\n<div class=\"wp-block-image\">\r\n<figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"640\" height=\"479\" class=\"wp-image-7313\" src=\"http:\/\/voice.flywheelstaging.com\/wp-content\/uploads\/2020\/12\/NOVI-SAD.jpg\" alt=\"\" srcset=\"https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD.jpg 640w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD-300x225.jpg 300w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD-80x60.jpg 80w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD-160x120.jpg 160w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD-240x180.jpg 240w, https:\/\/voice.org.rs\/wp-content\/uploads\/2020\/12\/NOVI-SAD-400x299.jpg 400w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><figcaption>&#8230;do Novog Sada<\/figcaption><\/figure>\r\n<\/div>\r\n\r\n\r\nOnly a month later (December 21, 2019), the company was awarded a contract with \u201cPogrebne usluge\u201d Beograd, PUC,<strong>\u00a0<a href=\"https:\/\/drive.google.com\/file\/d\/1SYgqH4YKiabfOPwFWYgo_9rLOeMvm3mQ\/view?usp=sharing\" target=\"_blank\" rel=\"noreferrer noopener\">worth<\/a><\/strong>\u00a0RSD 21.6 million (VAT excluded). \u201cRespect Legal\u201d won the contract at this public procurement as part of a bidding consortium, which also included \u201cTransfly\u201d, a company whose <strong>representative<\/strong> is Dan\u010de Uro\u0161evi\u0107 himself.\r\n\r\n\r\n\r\nLast year, \u201cRespect Legal\u201d was awarded contracts worth around RSD 60.7 million following various public procurements.\r\n\r\n\r\n\r\nIn July this year, the company moved once again, but this time from Belgrade to Novi Sad. It changed its name to \u201cRespect Legal Novi Sad\u201d, its owner and its director. With the initial capital of one thousand dinars, the company was taken over by a citizen of India,\u00a0<strong>Godhke Deepak Kumar.<\/strong>\r\n\r\n\r\n\r\nVOICE also discovered that the name of the new owner of \u201cRespect Legal\u201d appeared connected with 54 companies in Serbia. Godhke Deepak Kumar is a director of 43 active companies in Serbia. He is the liquidation manager in 10 companies, while one company has been removed from the BRA\u2019s records.\r\n\r\n\r\n\r\nThe business cooperation between Uro\u0161evi\u0107 and \u201cRespect Legal\u201d continued in 2020, when in July this year the City of Ni\u0161 awarded a contract to \u201cRespect Legal\u201d and \u201cTransly\u201d worth RSD 13,750,000.
